The German Association of Automobile Tuners (short: VDAT) has recently stated that warranty protection does not expire generally by fitting an accessory part from a third-party supplier. Similar to the rules that apply for legal guarantees, warranties also depend on the so-called “cause and effect relationship”, VDAT experts have pointed out. This means that cause and damage must be interrelated.
An example: If a problem arises in connection with a car’s electric seat adjustment within the warranty period, the manufacturer must not refuse the provision of warranty by citing specially fitted wheel.
The VDAT suggests: In case of a warranty refusal generally citing third-party supplier accessories, clients should ask for a written justification. On the basis of this, it is usually quite easy to find out whether the workshop and the car manufacturer, respectively, are treading on solid legal ground or not.
For any questions on this issue, consumers may seek the support of the VDAT. In case of evidently unjustified refusals the association offers affected consumers to get in touch with the manufacturer directly. If this proves unsuccessful the client may also resort to the legal protection of his interests.
